ARTICLE 1 – PARTIES TO THE CONTRACT

BUYER: The Customer

ARTICLE 2 – SUBJECT OF THE CONTRACT

This contract regulates the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the goods/services ordered by the Buyer electronically via www.internationalclinics.com, and possessing the characteristics and price specified in this contract.

The Buyer acknowledges and declares that they are aware of the basic characteristics of the goods/services, the sales price, the payment method, the delivery conditions, and their right of withdrawal, that they have confirmed these details electronically, and have subsequently placed the order in accordance with the provisions of this contract. The preliminary information and invoice available on the payment page of www.internationalclinics.com are an integral part of this agreement.

ARTICLE 3 – DATE OF THE CONTRACT

This contract is deemed accepted and entered into effect on the date ... when it is signed by the Buyer, having been pre-approved by the Seller.

ARTICLE 4 – DELIVERY

The goods/services shall be delivered to ... at the address specified by the Buyer.

ARTICLE 5 – DELIVERY COSTS AND EXECUTION

Delivery costs belong to the Buyer. If the Seller declares on the website that the delivery fee will be covered, then it will be borne by the Seller. Delivery shall be made within a reasonable time depending on stock availability and upon the transfer of the order amount to the Seller’s account. If the goods/services cannot be delivered within 30 days, the Seller must inform the Buyer. An extension of 10 days may be granted. If the order amount is not paid or the bank transaction is canceled, the Seller is relieved from the obligation of delivery.

ARTICLE 6 – BUYER’S STATEMENTS AND COMMITMENTS

The Buyer shall inspect the goods/services before accepting delivery. Damaged, defective, or packaging-compromised items must not be accepted. Goods accepted by the Buyer are considered undamaged. If the right of withdrawal is to be exercised, the goods must not have been used and the original invoice must be returned. If the payment was made via credit card and unauthorized use is detected, and the related payment is not made to the Seller, the Buyer shall return the goods to the Seller within 3 days, with the shipping cost borne by the Buyer.

ARTICLE 7 – SELLER’S STATEMENTS AND COMMITMENTS

The Seller is responsible for delivering the goods/services intact, complete, in accordance with the specifications stated in the order, and with warranty documents and user manuals, if any. Upon receiving the withdrawal notification, the Seller will refund the paid amount and documents within 10 days and will collect the product within 20 days. If deemed necessary, the Seller may provide another product/service of equivalent quality and price. If delivery becomes impossible, the Buyer will be informed and refunded. If repair under warranty is required, the Seller will cover all associated costs.

ARTICLE 8 – INFORMATION SECURITY AND PRIVACY

During registration and checkout, the Buyer must provide contact details, credit card information, and personal data. This information will be used for order fulfillment, service improvement, invoicing, logistics, and marketing purposes. Personal data will be securely stored and shared only with necessary third parties, such as financial institutions, under confidentiality agreements.

ARTICLE 9 – PRODUCT/SERVICE FEATURES

The type, quantity, brand/model, color, and total sales price of the product/service are detailed on the website and in the invoice issued at the time of order.

ARTICLE 10 – CASH PRICE

The cash price is specified in the sample invoice sent after the order is placed and in the official invoice issued with the goods.

ARTICLE 11 – INSTALMENT PRICE

If the Buyer selects installment payment, the total price, including interest, is detailed in the invoice based on the selected payment plan.

ARTICLE 12 – INTEREST

Interest rates cannot exceed those legally permitted by the Republic of Turkey. The Buyer is responsible for interest payments and obligations related to their credit card agreement with their bank.

ARTICLE 13 – DOWN PAYMENT

The down payment amount is included in the invoice provided to the Buyer after the order is placed.

ARTICLE 14 – PAYMENT PLAN

In installment purchases, the Buyer is subject to the installment plan selected during checkout. The Buyer can monitor payments via their bank statement.

ARTICLE 15 – RIGHT OF WITHDRAWAL

The Buyer may withdraw from the contract without penalty and without providing any reason within 7 days from the date of delivery. The Buyer must notify the Seller within this period via email or phone. The goods must not have been used and must be returned along with the original invoice. Upon notification, the Seller will refund the amount paid within 7 days and collect the goods within 20 days. If the original invoice is not returned, VAT and other legal deductions cannot be refunded. The return shipping cost is borne by the Seller.

ARTICLE 16 – EXCEPTIONS TO RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

  • Perishable or expired goods

  • Customized or personalized items

  • Opened software, CDs, DVDs, hygiene products, or cosmetics

  • Single-use medical supplies

ARTICLE 17 – DEFAULT AND LEGAL CONSEQUENCES

If the Buyer defaults on credit card payments, the Buyer shall pay interest and bear liability per the terms of the bank agreement. In such cases, the Seller may pursue legal action and claim damages for delayed payment.

ARTICLE 18 – AUTHORIZED COURT

In the event of a dispute arising from this contract, complaints and objections shall be submitted to the Consumer Arbitration Committee or Consumer Court in the jurisdiction where the Buyer resides, depending on the monetary threshold determined annually by the Ministry of Trade.
